Donations / Payments/ Direct Debit collection or Card payments and refunds.
By clicking the "Submit" or “Next” as defined buttons on our website, you authorize us to charge the account details that you have entered for the amount specified in the Transaction Amount field which will be used to deliver the objects of Nicodemus. Such transactions will be handled by either our Bank, Card collector or our Direct Debit handler. These are all selected professional deliveries of these services
If you selected the regular giving option, the account information provided will be stored securely via for automatic processing of your future payments. Please notify us at any time if you wish to discontinue your regular giving.
Refunds
We do not provide refunds unless:

a card has been used fraudulently. Under these circumstances we will require confirmation from your card provider.

a duplicate payment has been made.
-
any refund request should be made within 40 days of the transaction date.

Training, venue hire & consultancy booking terms and conditions
General Statements applicable to venue and land use:

Nicodemus has a duty and testimony to maintain within the local village. Noise is to be minimal between 10pm and 7.30am to respect our neighbours. Hirers bringing Nicodemus into dispute will be asked to leave the site.

Nicodemus requires that all people, attending our venues or camp site, caring for children, young adults or vulnerable adults in organised sessions, be DBS checked to the appropriate level and that this is the responsibility of the hirer. Due to this requirement any booking or use is on the basis that this has been applied with.

The Hirer will leave any Nicodemus venue or camp site clean and tidy after your use. Charging for con-compliance are detailed in the fees section of these terms & conditions.

The hirer will take any rubbish with them to dispose of off-site.
-
All gates should be left closed.
-
No feeding of livestock or wildlife.
1. Definitions
Donor
Individual, corporate, school or any entity making a donation or grant to the charity
Customer
The person or partner identified as enrolling a delegate
Delegate
A person attending the event and may include a customer
Event
Courses or conferences offered by Nicodemus at the stated 'venue'
Materials
Any documentation in either machine readable or printed form
Venue
The location at which an event is held
Working day
Any day from Monday to Friday (inclusive) which is not a statutory bank holiday in England
2. Orders and acceptance
2.1 - The customer is deemed to accept these terms upon enrolling upon an event or purchasing any of our services or products and is responsible for ensuring the accuracy of all details submitted.
2.2 - These terms govern the booking for the event to the exclusion of any terms and conditions of the customer. The booking form incorporates these terms and constitutes a legally binding contract.
3. Fees
3.1 - The price for a product is per booking/purchase (consultancy, subscription, training course, venue hire, resource) as specified for the product.
3.2 – The minimum term for a subscription is 12 months to entitled to free additional services beyond the online training platform. If the partner ends this earlier the full balance of the remaining 12 months becomes due. (for example if Standard+ subscription was purchased and the free venue hire was used during the first 6 months and the subscription cease after seven months = 5 months subscription would become due).
3.3 – any venue (building or land) should be left clean and tidy and the kitchen wiped down with appropriate cleaning materials by the hirer or whoever they may delegate. If any additional cleaning is required, this will cost £80-£200 dependent upon the condition the premises are left in. Any damage done will also be charged for.
3.4 - Prices are correct at the time of going to press but may be subject to increase.
4. Payments
4.1 - Payment in full must be received at the time of booking. We accept payment by direct debit, card, bank payment or cheque depending on the style of purchase/booking (this is guided throughout your purchase).
4.2 - Nicodemus reserves the right to refuse admission or delivery of a purchase for any failure by a customer to pay fees as specified in the product.
4.3 – A payment receipt is generated when booking or purchasing OR payment occurs on the successful payment collection by Direct Debit.
4.4 – A subscription receipt is the original purchase receipt.
5. Reservations
5.1 – Consultancy or venue booking will initially generate a reservation which is NOT confirmed until a payment is received when a confirmation will be sent or direct debit has been collected when a direct debit receipt is sent.
5.2 – Bookings, services or resources are not confirmed until a booking payment receipt has been issued.
6. 'Venue' and content of event
6.1 - Nicodemus reserves the right to run events at a different 'venue' to the one specified, when necessary. If this is the case Nicodemus will inform the customer as soon as possible and provide information about the revised 'venue'.
6.2 - Any opinions expressed by speakers at any event are their own and not necessarily those of Nicodemus should Nicodemus retain external speakers.
6.3 - Nicodemus will endeavour to ensure that the published programme/product is provided. However, Nicodemus reserves the right to alter published programmes, dates and speakers according to circumstances. Nicodemus liability in respect of such change will be limited to a refund of the customer's fees if so requested.
6.4 – Venue Capacity:

Manor Barn, Oxhill, Stratford Upon Avon venue for 50 people (MAX) unless by arrangement, dependant on use.

Oxhill Manor land, Oxhill, Stratford Upon Avon for camping 20 people (MAX) unless by arrangement, dependant on use.
7. Cancellations
7.1 - Nicodemus reserves the right to cancel, postpone or otherwise alter the content or date of an event without notice. In such circumstances, Nicodemus may, at its own discretion, return any payment received without penalty of a cancellation charge.
7.2 - In the event of cancellation by a delegate or the customer, cancellation fees will be due as follows. If you:

Cancel an order or change date for a consultation less than 14 days before the confirmed booking date you are entitled to a refund of 0% and no change of date. Longer than 14 days you are entitled to a change of date

Cancel an order for venue hire 28 days or less before the confirmed booking date you are entitled to a refund of 0%. Longer than 28 days 100% refund or change date

Cancel an order for camping hire 28 days or less before the confirmed booking date you are entitled to a refund of 0%. Longer than 28 days 100% refund or change date

Fail to attend a consultation booking, venue booking or camping hire you are not entitled to a refund
-
Resources are non-returnable, so no cancelation applies
7.3 - To request a refund in accordance with the above you must notify us in writing by email to supportercare@nicodemus.org.uk. You will then be entitled to a refund from Nicodemus or change of booking date in accordance with the terms above. Any refund due will be paid as soon as possible, but in any event within 30 days.
8. Substitutions
Bookings are not transferable to others.
9. Personal belongings
Personal belongings and items belonging to or in the possession of the delegates brought into the venue are the sole responsibility of the owner and Nicodemus accepts no responsibility for such items. Delegates using the car parking facilities at the venue do so entirely at their own risk. Nicodemus accepts no responsibility for damage, accident or loss resulting from such use.
10. Force majeure
Nicodemus will not be liable for any failure or delay in the delivery of the event which is caused by circumstances beyond its reasonable control. Where such an event occurs Nicodemus obligations will be suspended for so long as such circumstances continue, or the event may be cancelled in which case the provisions of clause 7 will apply.
11. Copyrights
11.1 - Nicodemus reserves all rights in the content of all events and Materials. By signing the booking form customers acknowledge that all rights in the content of events and materials shall be owned by Nicodemus and that in attending an event or viewing content on our online platform partners will not obtain any rights whatsoever in such content or materials.
11.2 - The customer agrees not to reproduce, sell, hire or copy materials (in whole or part) and not to use such materials except for the purpose of post event reference.
11.3 – Signing of the booking form, electronically by submission on our website for any service or purchase will be deemed to have taken place at the point of payment.
12. Data protection
12.1 - Details of the customer and delegate will be added to the Nicodemus database in order to process your booking and so that Nicodemus can keep you up to date with services it offers. All data is processed in accordance with Nicodemus privacy policy.
12.2 - If you do not wish to receive any further information from Nicodemus please notify us by post, email or telephone on 0207 112 8341.
13. Limitation of liability
13.1 - Except in respect of liability for death or personal injury caused by Nicodemus negligence (for which no limit or exclusions of liability apply), Nicodemus aggregate liability, whether for damages or compensation of any nature arising from the contract for the event (including as a result of negligence) shall be limited to the total sum or sums paid by the customer for attendance at the chosen event.
13.2 - Nicodemus shall not be liable in respect of loss of profits, business, revenue, goodwill or anticipated savings or indirect or consequential loss or damage (whether caused by negligence or otherwise); or any act, omission or breach of contract by the customers employees, agents or sub-contractors.
14. Miscellaneous
14.1 - If you have any additional requirements due to a disability or any other reason, please notify Nicodemus to discuss requirements.
14.2 - Nicodemus will not be liable for any travel or other expenses incurred by delegates attending events.
14.3 - Delegates agree to comply with both Nicodemus and the venue's policies and procedures at all times during the event. Where the delegate does not sign the booking form for an event, the customer signing the booking form shall procure that the delegate is bound by these terms.
14.4 - Nicodemus reserves the right to refuse admission to any person whom it considers in its absolute discretion to be unsuitable for admission to the event or to remove any such person after the commencement of the event.
14.5 - The contract arising from a booking does not create or infer any rights under the Contracts (Rights of Third Parties) Act 1999 which are enforceable by any person who is not a party to the contract.
14.6 - Any contract arising from these terms shall be governed by and construed in accordance with English law and any dispute that may arise between the parties concerning these terms or any contract arising therefrom shall be subject to the exclusive jurisdiction of the English Courts.
Nicodemus venues conditions of hire
1a. Food or beverage items may be consumed on or outside the premises providing litter is taken away and all areas inside and outside are left clean.
1c. No alcohol is permitted to be brought to the premises unless by prior arrangement
1b. Food hygiene. All caterers must have a current food hygiene certificate under government regulations, which should be updated every 3 – 5 years. There is a FSA book available entitled Safer Food Better Business available from https://www.food.gov.uk/business-guidance/safer-food-better-business-for-caterers or call 0845 6060667) to enable you to comply with current legislation. The Level 2 Award in Food Safety for catering is available to be completed online.
2. First-time hirers may be required to furnish names and addresses of two referees, one of which must be the hirer’s banker. Nicodemus reserves the right to approach those named before confirmation of the booking is made.
3. The hirer shall be responsible for paying all charges arising from the booking, including any cancellation fees.
4. Cancelation more than 4 weeks before the venue hire date is refundable or changeable to a different date ONCE only. If the venue hire is a part of a subscription, this is not refundable in £s and may be moved to a changed date or cancelled ONCE if more than 4 weeks from the venue hire date. Less than 4 weeks before the venue hire date is not refundable, if purchased, and counts as a ‘free use’, if is a part of a subscription.
5. The charge for the hire of the room(s) will be fixed from the time you receive written confirmation of the booking. All other charges will be based on the price list current at the date of the event. Nicodemus reviews prices annually.
6. The hirer is responsible for arranging their own catering. External caterers or a hirer providing own food & drink must leave the premises clean and tidy.
7. Nicodemus shall not be responsible for any loss or damage to any property arising out of holding a function or any injury which may be incurred by or be done or happen to any person during the holding of a function arising from any causes whatsoever, or for any loss due to breakdown of machinery including technology i.e. Internet access, PA use, projector use, failure or supply of electricity or telephone, leakage of water, fire, riot restriction or act of God which may cause Nicodemus premises to be temporarily closed or the function interrupted.
7a. Use of Nicodemus wireless Internet - All users of Nicodemus wireless Internet are governed by UK legislation; this includes the Computer Misuse Act 1990. Details of any users found to contravene this legislation will be forwarded to the authorities.
7b. The hirer shall be responsible for any loss or damage arising from their participants misuse of Nicodemus wireless internet.
8. The hirer shall be responsible for ensuring all equipment brought on to the premises and for any damage caused to Nicodemus property by any person, equipment or exhibits brought on to the premises by the hirer.
9. The hirer shall pay all charges upon booking unless by different arrangement on an individual basis. No contract exists until payment in full has occurred (unless a free use as a part of a subscription in which case free use confirmed).
10. Nicodemus reserves the right to cancel confirmed bookings if the subject contravenes Nicodemus aims and objectives.
11. Nicodemus strongly recommends that the hirer has adequate public liability insurance.
12. The hirer must ensure that nobody under 20 is left on site unsupervised by an over 20 year old.
13. The hirer is responsible for undertaking all necessary risk assessments in relation to the function and any activities they organise or of people in their care.
14. Nothing in the agreement between Nicodemus and the hirer confers any rights on third parties.
15. Nicodemus reserves the right to refuse entry to persons if in Nicodemus opinion, such persons cannot be safely accommodated in the rooms allocated or if such numbers would likely cause a breach of any regulations affecting Nicodemus.
16. Nicodemus reserves the right to alter these conditions at any time without notice. The hirer agrees with Nicodemus to observe and perform the provisions and stipulations contained or referred to in Nicodemus ‘Conditions of hire’ for the time in force (an understanding of which the hirer acknowledges), together with any special conditions which may be imposed.
17. Venue capacity will not be exceeded, unless arranged and confirmed in writing with Nicodemus.
18. The venue should be left clean and tidy, and the kitchen wiped down with appropriate cleaning materials. If any additional cleaning is required, this will cost £80-£150 dependent upon the condition the premises are left in.
19. Smoking including vaping, alcohol are not permitted on site, unless by specific arrangement. Please note the following will not be tolerated and could result in the centre asking you to arrange for group members to leave: Taking illegal drugs, tampering with electrical equipment/lighting, tampering with fire alarm systems (including covering or removing smoke detectors), tampering with fire extinguishers, aggressive behaviour towards other guests or staff, fighting, theft/entering accommodation assigned to other people without permission.
20. For the benefit of other users on site and our neighbours, groups are requested to keep noise to an absolute minimum from 10pm – 7.30am particularly loud music. We would also ask you to be considerate to our neighbours if you are out on walks or activities in the dark. No fireworks should be let off at all. If this happens you may be requested to leave the site immediately.
21. Dogs are not permitted at any Nicodemus venues, unless by agreement (with the exception of guide dogs or dogs used for other health related reasons).
22. Groups are advised to bring their own supplies and to appoint someone to be responsible for first aid.
23. Any use of Nicodemus hardware must be by a competent operator (eg PA or projector).
24. PPL & PRC licence. Please Note all groups playing music, displaying words etc. Must have the appropriate licences. Information on these can be obtained from www.ccli.co.uk
25. Whilst using Nicodemus premises the group leader of the relevant group visiting accepts full responsibility for the members of their group’s use of the premises or any activities on site. Nicodemus assumes no liability for injury or death, damage to or loss of personal property, accident, delay, cancellation, irregularity or inconvenience caused, save where such loss is caused or contributed to by the negligence of some person acting as a servant or agent of Nicodemus.
26. Nicodemus has a public liability insurance cover for £5 million. Groups however need to take out insurance to cover their own activities. Nicodemus and its directors and staff cannot accept liability for damage to or loss of personal property and groups are advised not to bring personal items of value with them.
27. All individuals in groups are welcomed and equally valued and respected regardless of their gender, race, religion, age, sexual orientation, or physical and mental capabilities. Christian groups are welcomed on acceptance of the "Basis of Faith" published by the Evangelical Alliance.
Camping or use of surrounding Land (30 acres)

Nicodemus expectations of Health & Safety responsibilities of the hirer.
This is for guidance as ultimately the customer/partner/person responsible for the Customer’s event are responsible for your Group’s health & Safety.
Health and Safety Law places responsibilities on all those who use Nicodemus venues in any capacity.

Hirers have a general duty to:

To ensure all in your group are aware of their responsibilities

To comply with Nicodemus local safety rules.

Not to tamper with safety equipment

To co-operate with the employees of Nicodemus
Reporting Accidents/ Incidents
It is very important that accidents/incidents are reported to Nicodemus, in addition to your own procedures, as soon as possible after the event. This is to ensure that similar accidents/incidents can be prevented elsewhere, and that Nicodemus can meet its legal duties. It also ensures that you have been seen to act correctly.
Fire – General
A fire, even a small one on the Nicodemus site is a serious matter, with fire and generated smoke being a real killer. The best way to handle a fire is not to allow it to happen in the first place.
Simple preventive actions can so easily prevent fire,

Don't use defective equipment, plugs and switches

Don't smoke within Nicodemus buildings
-
Don't cover heaters, electrical equipment or sources of heat
-
Don't obstruct fire routes & exits
-
Ensure that fire doors are kept closed
-
Ensure you switch off all electrical equipment when not in use
-
Ensure paper and other waste materials are kept to a minimum and regularly remove from the building particularly in corridors and assembly areas.
It is your responsibility as group leader to ensure that you:

Make sure that you, and those that you are responsible for, know what to do in the event of the fire alarm sounding.

Know the numbers and names of all those in your group at all times. Ensuring particularly during an evacuation that you have these with you.
-
And those responsible for children, people with disabilities or special needs, including partially sighted or impaired hearing, have procedures in place to assist with their emergency evacuation should it be necessary during their stay.

Know how to get everyone out of the building safely.

Assembly points are located in the field beyond the car park or in the field to the left of the Manor (from the front)

Make sure that you have read and understood what your responsibilities are, as a group leader, in the event of a fire
First Aid
As organiser of your group it is your responsibility to ensure that you have considered your first aid requirements and have a delegated person responsible for this during your stay. The qualification is valid for 3 years. Please ensure the delegated person has a current qualification, either an appointed person or First Aid at Work.
Please ensure the names of the first aider/s on duty, is/are displayed/communicated and ensure you supply your own first aid box with adequate equipment and your group is aware of the location.
If you have individuals in your group with complaints or illnesses, which may impair their normal function, make sure that you know about the condition and what is needed in an emergency prior to their stay. A typical example is food allergies; it is vital that your cook knows of such conditions, however mild or severe they may be. Your cook is responsible for complying with UK regulations on included allergens food labelling. Anaphylactic shock can be life threatening, please ensure these details are also passed on to your caterer. You are responsible for carrying out specific risk assessments if you consider it necessary.
Disabilities, Special Needs etc.
Those responsible for disabled people or those with special needs including partially sighted or impaired hearing, must have procedures in place to assist with their care during their stay, particularly in the event of the fire alarm sounding.
No entry of the ponds or river
It is the hirer’s responsibility to ensure that all individuals (whatever age or circumstances) in their groups are always be supervised near the ponds or the river.
Bonfires
Although the land area round Manor Stables is classed as private (which is why we are allowed bonfires) the public still have right of access. We do not want to lose the opportunity for groups to have bonfires so please be sensitive to this at all times! All bonfires must be extinguished and cleared away, once cool. You must request to have a bonfire if you wish to have one and agree with Nicodemus where to have it.
Risk Assessments
Please be sure you have fully risk assessed ALL of your activities to ensure the safety of your group.
Electrical Equipment Safety
Nicodemus seeks to ensure that its work equipment and electrical equipment is maintained to a high standard and repaired quickly.
There is a PA system in place for public address, playing music and a band. Please do not connect any other equipment into this system without seeking permission.
Any equipment or electrical equipment, which is leased, loaned or brought in from ‘home’, must be safe to use, ideally it should be PAT tested prior to your use. We cannot accept responsibility for any damage caused by your equipment, and we reserve the right to make a claim should such equipment cause damage to Nicodemus property.
